single parent issue

recently my uncle expired due to kidney failure now aunty left alone with her son and daughter in law.... it's our responsibility to take care of our parents right.....my question is if any person not taking care of their parents.... avoiding them...... ignore them....... Indian laws can stand against son and favour to the parents...... any way to take care of those parents..... or any other legal way.....

Yes we have a law for the parents maintainence so they can file a case and a criminal complainant as well against them.

You can also report about ill-treatment or not supportive of your aunty to District Collector and Legal Services Authority.   With this step you may bring some solace temporarily, but the issue may be complicated by begging outsiders for mercy, as those persons who ill-treated her my further complicate the issue and subject her to more miseries.  There are many old age homes, that may take care of those unfortunate persons.  You may search for the same and accommodate her there and authorities may direct son to pay for her maintenance monthly, if she is not a pensioner already, or may take action to dispose of some property in which she is a co-sharer etc.   Meet any Senior Citizen welfare organization or women welfare organization for a suitable remedy.

In order to live a dignified life, a person requires basic amenities like food, clothing, shelter and other necessary requirements. It's a moral duty of a man to fulfill such basic requirements of his parents, children and wife under Section 125, CrPC. Senior citizens who are dependant upon their children or grandchildren may also claim maintenance under The Maintenance and Welfare of Parents and Senior Citizens Act, 2007. This brings a legal obligation on children or other legal heirs to provide basic amenities to parents or grandparents. This act enables parents (both mother and father, whether biological, adoptive, step) and grandparents (both maternal and paternal) to claim maintenance from their children or grandchildren respectively. In case of no children or grandchildren, senior citizens can claim maintenance from their relatives. The condition to claim maintenance under this act is that the person must be unable to maintain her/himself from her/his own earning.
