You can have a LIVE in Relationship with Unmarried Girl without divorcing your wife.

This is not a Crime.

Even you marry her only in presence of your parents and her parents without clicking any PIC or Video that is fine. But ensure no PIC or Video and only your parents and her parents.

In that way you are convinced that no marriage has taken place and the girl is convinced that there is marriage and she is your wife.  That way you pave your way to jail on the charge of rape when relations get sour and she comes to know that in your opinion she is not your wife.

I think you should go through the rape law properly. You also should know that many girls has been punished for filing false rape cases.

 

Live-in relationship and rape is not equal.

I would like to request every victims to boycott family laws. This might again incur you in 498A.

forthy exception to S/375 reads as under :-

 

Fourthly.—With her consent, when the man knows that he is not her husband and that her consent is given because she believes that he is another man to whom she is or believes herself to be lawfully married.

I have not advised even live-in or 2nd marriage.

 

Hi, Let me tell you , I have a friend in Chandigarh and he is living in same status , 498A/Divorce case is pending , but he decided to move on in live in relationship with other girl , Infact 498A wife came to know about this from some Neighbours. 

498A cried in court mentioning that he married to other girl , But she cant proof it even after having a voice recording of Neighbours. 

But since he is into livein wiith unmarried girl , there are not adultery charges on him.

 

YES i 100% agree to shonee sir that if 2nd girl want she can screw your life very badly , if she want she can anytime file 376 Rape case ,But trust me having s*x with any girl /girl friend / prostitues is not safe because if girl file 376 , then there is no bail and such case runs in FAST TRACK and situation will be worst if girl is below 18 , ofcourse you are not moving in livein with below 18 girl.

So you need to be very carefull about the same

shonee ji but if no live in no 2nd marriage without divorce it means life is over because after 10 years i have baba ji ka thulu in my hands even though court gives judgement in my favour. every thing is suffering in my life. my mental peace my professional growth only because of this bloddy 498a. there is no short term solution except to end the life. creamy time of my life will be gone into court if i will not start live in or do 2nd marriage sooner or later there will be rukess in my life. because it is easy to say 10 years will caseruns but it will ruined the life. and my fault is that i cant tolerate my wife extra martial affairs.

I agree, that is why I never advocate to wait for divorce till other cases are over. You can either have your cake or eat it. "Babaji ka Thullu" or not is dependent upon what are your choices and how pragmatic you are in achieving those. If you chase useless sh*t; you would have to satisfy yourself with "Babaji ka Thullu"

So clearly she should have some evidence as per Indian Evidence Act 1872 to "Believe her marriage is lawful"?

 

And what I have advise here ? not to keep any evidence of second marriage ?

a) Don't go speedy trial.

b) Don't go for DP3.

c) Don't go for Wirt since this not easy.

d) Don't go for second marriage or live-in.

e) Don't go for RCR.

ok - If you are sure that second girl is not a bad girl  and will not cheat you with DV/Maintenance/Rape case then go for marriage ,So be aware she can frame you easily in DV/Maintenance/Rape if she want to do so.

1. How many Speedy Trial petitions have you seen succeeding? 

2. How many DP3 have you seen, which has not been quashed?

3. Which WRIT? I don't understand this word WRIT, I understand Specific WRIT. Each WRIT has a specific purpose, and can not be used indiscriminatory

4. I don't advise to have a live-in or 2nd marriage during subsistance of first marriage. If caught your position would be much much difficult.

5. I have reasons for RCR.

 

I think, if you fight cases well, you can win. Don't lead people just by the words and fancy ideas. First it was RTI and Contempt of Court which was touted as a panacea for all problems, now it is Speedy Trial.

 

Don't settle, but don't expand your energies in useless manner.
