My Father was a retired driver, he joined the corporation in 1979 & he dismissed from service in 1995 due to road accident.  The case was taken to labour court and awarded to provide job without back wages and issued direction not to count the period in between (1995 to 2002)for any retirement benefits. He joined in 2002 and retired from service in 2009.
Further we received letter stating us to pay 2Laks approx due to excess salary payment made by corporation.  As it was not acceptable and illegal we approached the chennai high court, corporation made argument of my father was appointed as a fresh employee by not considering his service of 16 years.  Court was ordered to corporation to clear the backwages and provide pension benefits within four weeks by deducting 2laks of excess payment made to my father already. As there was no response from corp. we filed another case in 2013 which is pending for long time.  My lawyer keep saying lack of judge.  please advice how to proceed further.

You can file an application to expedite the hearing.
