Requirement criminal complaint

i want to know if accued make forgery and to recover my losses  i want to issue notice with discripttion of foregery. But at same time  before reply from them it is possible to file criminal complaint at police or court 156 (3) for foregry 

 

pls guide

The query is short of material facts. Mere suspicions or allegation do not constitute an offence of forgery.

You can report to the Police. FIR would be registered if the facts disclose an offence.

If you are aggrieved by the acts of forgery or cheating by someone then you can approach police with a criminal complaint to initiate legal action against him as per law.

If the police is reluctant to take any action then you can approach judicial magistrate court with an applicaiton under section 156(3) cr.p.c. seeking direction to the concerned police for initiating legal action on your complaint.

File a complaint before jurisdictional police or area Magistrate.

No need of a legal notice to be issued to the accused.

However, you will have to seek  professional services of a local prudent lawyer for analyses of facts as applicable in your case,  which has to be specific and cannot be generalised / presumed, proper guidance and proceeding
