Required space between new and existing construction.

If I leave 4ft gap in ground floor from an existing building and then extend aerial construction 2ft for rest of the floors is it illegal?

What does the building bye-laws in your locality says?  Without knowing that it will be difficult to answer your query.

However, Prima-facie, if you are required to leave 4ft gap in ground floor, then you are required to maintain the same throughout.  Therefore your not leaving that requisite gap on the upper floors appears to be infringing the law.
