Registration of sale deed

TOPIC:   UNREGISTERED SALE AGREEMENT:

I am a Very senior citizen.  Wanted to purchase a Property (Flat- 10 years old) for Rs.40 Lacs.   Remitted the amount by RTGS  to the Seller and received by the Seller on that day itself. Date of Registration is fixed on the next day.   The Seller did not turn up for Registration. Reason given - unavoidable circumstances could not come for Registration.  It is now moe than a month.  Neither he is willing to cooperate  for Registration nor ready  to return the money back.

I have an UNREGISTERED SALE AGREEMENT with  conditions for Return of the money.

  1. Can I enforce through the UNREGISTERED SALE AGREEMENT and try to get the money back through COURT OF LAW?   Nowadays lot of adjounments are taken and to get a verdict soon is nothing but impossible.
  2. Whether to lodge a complaint with Police and take criminal proceedings to get back the money?
  3. Whether SALE AGREEMENT also should be Registered to safeguard ones (my) interest?

The sale agreement also shall be registered.  Send him a legal notice to register the house or return the amount.  Consult a local lawyer for further guidance and to file a case against him if necessary.

The  agreement to sell is valid even if it is "unregistered" but notary attested.

You should issue legal notice for specific performance of contract to execute sale deed through a local prudent lawyer.

Why does / what for a "very senior citizen" require to purchase a flat and invite problem(s) to torture himself ?

To my knowledge, it is not mandatory that a sale deed be registered.

You can approach the proper court for specific performance of the agreement of so desire otherwise get back your paid amount. 

You need not worry about the agreement.It is valìd document eventhough it is not registered You decide  whether to get back your money  or purchased house. Choice is yours.

Sale deed has to be compulsorily registered u/s 17(1) of The Registration Act, 1908, which is yet to be executed in the instant case.

dear sir, 

  1. send a legal notice 
  2. file for civil suit for specific performance and suit for recovery of rs 40 lacs in alternative with interest. you can file civil suit if the agreement of sale is attested by notary or executive magistrate. registration of agreement of sale is not necessary.
  3. also file application under order 39 rule 1 and 2 seeking injunction so that the defendant may not sell the property to some other person till your suit is pending before appropriate court of law.
  4. lodging a complaint before police authorities wont help you. however can become a part of evidence if neither your agreement of sale is registered or attested by notary or executive magistrate. 
  5. your suit is within limitation period.

You can find relief only through legal sources otherwise the reluctanct vendor will not come forward either to execute the registered sale deed or refund of the amount received.

You consult an advocate in the local and proceed legally as suggested

1, positive u can enforce agreement through court of law either for property or refund of money, 

2, filing police complaint is not advisable , send him notice to come for registration 

3, in tamilnadu registration of sale agreement is  mandatory and unregistered sale agreement will be considered as only coorbarative evidence. and u not mentioned about possession.

Whetther Tamilnadu has its own (State) Registration Act to provide for compulsory registration of "Agreement to Sell" ? If so, it is not in my knowledge, please elucidate.
