Query about cheating

Sir,i was engaged with a boy few months back.They were told us and given a profile that he had MBA.But after the function we got a information that he only posses higher secondary education.Then we asked them to show us certificate.But they failed to do it.We waited few weeks and requested to kindly show it.But they were given the reasons like certificate were given in company.So we asked just show the softcopy,but they dont.So we decided to cancel the engagement.I am doing masters .During the engagement we were given them some cash and gold.They were told us they will give it back at the sametime they escaped and gone to saudi arabia.Then we contacted them and they told a date to give it back.But they failed to do.What are legal actions that i can charge on groom and his family?? How long it take to get back our cash if we go to court?

You can initiate civil and criminal action. Perhaps it would be in the larger interests of both the families to reach an amicable settlement.

if you have any document to prove that the person lied about qualification before engagement, and he is really not that qualified, will help you in the case. you need to prove cash given, limit on cash is 2 lakh only. Jewelry no limit (bill of jewelry), videography, photos, and if you have messages or emails regarding the same that will also help you.

Sir if the cash given is more than 2 lakh ,is there any problem that we have to face in the court?

the receiver of the cash is liable to be penalised and not the payer, but you need to prove cash payment.

You can first issue a legal notice to them demanding return of your articles and cash.

If they fail to respond or comply then you may first lodge a criminal complaint with the police for the offences of cheating and file a civil suit for recovery on the basis of the evidences in your support.

Instead of seeking a legal recourse it is better to settle the issue amicably roping in some common relatives, friends, respectable persons of society etc.
