PW1

Hi all,

I have a query. In my both dvc and nullification of marriage case, pw1 stage has came. I have to file PW1. In regard to this I need help.

DVC case:

In PW1 of dvc does signature of other advocate is necessary in addition to my advocate?

Divorce

In divorce case my lawyer is not helping, so can I file PW1 alone without my lawyer or her signature as advocate is necessary?

also advocate signature other than my advocate is also compulsory?

If you are quite confident of the contents of the affidavit have been properly mentioned by you in your affidavit, which you are calling as PW1, your advocat's signature is not necessary either in DV case or in divorce case.  What you have to do is to prepare affidavit and take it to oath commissioner and get his signature.  There are two signatures on the affidavit.  One is identifying the deponent (means yourself) and second is oath commissioner's signature.  If the oath commissioner is willing, he can put his signature at identification also, after seeing your identity card.  Hence, your advocate's signature is not vital.

Oath commissioner is an advocate having not less than 10 years of standing and is designated as "oath commissioner" and he will put his signature along with stamp on affidavits.  He is also entitled to identify the deponent.  In that case, the signature of two advocates is not required on the affidavit.

is it compulsory that petition and pw1 shall be same. Please clarify in respect of both divorce case and dvc case.
