Provident fund claim for a Dementia patient

Hi,

My father has dementia since past 3-4 years. Now, he is unable to sign, recognize distant relatives, etc.

My mother has been struggling to claim his provident fund from his college (under Agra University) where he was a Professor.

The college lawyer says that LTI will not be accepted. I did some net search as well, and got to know that Mental Health act of 1987 will also not apply in my father's case.

So, I am having a tough time trying to find out what law and procedure can help us.

Any advice on this matter will be highly appreciated.

Many thanks!

Saurabh

Aminur,

Thanks for your reply.

Do you think we can obtain a POA easily, given that he cannot sign or even recognize me and my mother (most of the times)? And I believe that LTI will not be valid in this case too. Please correct me if I am wrong.

Also, how much time will it typically take to get this POA?

Thanks!
