Property issue

 

My Grand Father was the initial owner of our house. Since he expired the name was transferred to my Grand Mothers Name. My grandmother has two children, 1 daughter & 1 son (My Dad).  My Grandmother is in her late 70’s she does not remember if anything been told to her. Hence her daughter (my aunt) is taking advantage & wants to sell the house and get her share. By dad is a Paralytic patient, by any chance can my dad go against his mom or his sister. He wants to live in the same huz. Can I intervene into the property and claim my share too ? Because I don’t want to sell the house.

Since your grand mother is alive, no body is having right on the property. Whe she writes a WILL and executor only will have to power to enjoy the property. So my suggestion is that you have to look after welfare of your grand mother and then your parents.When you get any legal notice then your are all people have to respond.

Son; daughter; widow; mother; son of a pre-deceased son; daughter of a pre-deceased son; son of a pre-deceased daughter; daughter of a pre-deceased daughter; widow of a pre-deceased son; son of a pre-deceased son of a pre-deceased son, daughter of a pre-deceased son of a pre-deceased son; widow of a pre-deceased son of a pre-deceased son.

Hence if at the date of his death your grand father has left only your father then he will get the whole property.you as grand son can not ask if your father is alive.

IF your grand father made a will in favor of your father and your father does not want to claim but want to surrender his rights making you absolute owner just in his life time then it can be done only by a registered Gift Deed executed by your father and accepted by you,no other alternate would be there.
