Hi experts, need your help.
We are residing in a flat for past 26 years which was owned by my grandfather. He expired in April 2017 and had made a registered WILL. According to the will, there will two owners my brother with share 25% and my bua (aunt) 75%.
According to the will, my brother and my aunt can jointly sell the house. Also, my brother can live in the house only on the consent of my aunt. Now my aunt has withdrawn her consent.
The current value of the flat is Rs 80 lacs so according to it my aunt is asking for Rs 60 lac.
My parents and my brother had put their hard earned money for the renovation of the house close to Rs 15 lac and at that time my grandfather said that he will give house to my father but my father didn't get anything.
And now we don't have Rs 60 lac to pay to her. We can give her Rs 45 lac as her share.
Now I have the following queries:
1. Can a grandson i.e. my brother can have a full right on right?
2. If my aunt takes us to court, in how much time the case will be solved?
3. Can my brother take stay order from court?
4. As mentioned above, we have incur Rs 15 lac on renovation, so can my brother claim this amount from our aunt?
