Promissory note

Sir/s, 

My tenant is over due for many years. Now he is coming for vacating, he would like to give some amount and a Promissory note or bond. Dues are over Rs seven lakhs. 

I am in Hyderabad, tenant is stationed in Gujarat. 

No rental agreement entered. 

I have noted in a book due amount. 

How to create a promissory note or any type of bond. 

Please guide.

A promissory note is not sufficient.  It is valid for 3 years only. So send him a legal notice to pay the due amount. If he fails to comply, file a civil case against him for the recovery of the amount.

Issue  legal notice followed by suit for recovery of the amount through a local prudent lawyer

Issue legal notice by furnishing your ban detais to tenant and ask him to deposite due rent in your bank account.

Issue a Formal Notice: If rent remains unpaid past the grace period, send a formal written notice (e.g., Pay or Quit Notice) stating the amount owed and the consequences.

Review Legal Options: Under rental laws in India (or your specific region), if a tenant refuses to pay for an extended period, you have the legal right to send an eviction notice or file a suit in a civil court.

Use the Security Deposit: As a last resort, you can draw from the security deposit to cover the shortfall, though this usually requires the tenant to replenish it later.

You may proceed by issuing a legal demand notice instead of going by the promissory note route, after which you can file a suit for recovery of your dues through civil court

You also have the option of settling the issue under the aegis of Taluka or District Legal Service Committee/Authority and getting an Award executed on agreed terms. The Award, if defaulted, could be got executed through a Civil Court.
