Procedure for taking signatures for fsl report

Procedure for taking Signatures for FSL Report

When a signature has been disputed by the complainant and an FIR has been filed for forgery, then during the Investigation what is the right procedure for the Police for taking the specimen signatures of the accused for FSL Report/Opinion.

Is there a need / procedure to take the specimen signatures in front of some independent witness or the IO can singularly take the signatures of the accused in a closed room and send them for FSL: examination?

Please give the Judgment, citations that might help

The  specimen signature of accused is obtained in the presence of Magistrate/ police official.

Without the permission of the court and before the court the IO has no right to take any specimen signature in Criminal case of forgery.

for judgement you have to search through google, kanoon.com, judis.nic.in, manupatra,

Yeah Nadeemji,

That is the position, true! But I need either the law on the subject or the relevant provision in the CrPC!

Is any one aware of the guidelines if any laid down the SC on the subject

The vital point remains unanswered

Is there a need / procedure to take the specimen signatures in front of some independent witness or the IO can singularly take the signatures of the accused in a closed room and send them for FSL: examination

Any one with any case law or any guideline on this?

The prime thing involved is forgery, why should any body question (forget about law) to contribute his signature for verification ?

(Whether it is taken before Court or before independence witness, literally speaking there is no difference, and infact it helps the person who signed to raise objection in court during proceedings in his defense and if there are violations in procedure)
