Possession of flats

Hi I am Anirudh,

I was booked the flat in "Acruti Countrywoods" (Now HUBTOWN) on Oct'2009 and registered is done on Oct'2010.

However, the date of possession was Dec'2010 as per the sales deed. Now after waiting for over more than 2 years they have completed the construction work of few apartments (part of whole society).

Instead of apologizing for giving the late possession. They are slapping the Penal interest on us when we had clear all remaining installments and payments related to service taxes, It's like pot is calling the kettle black. We have discussed this issue with all everyone in HUBTOWN in Pune and Mumbai but they are completely ignored their mismanagement and pointing fingers on the us. On top of that they are showing adamant attitude.

Apart of this they are putting unconditional demand of signing a supplementary agreement which states that we the customer having no objection with the delay in construction and agreed on the new date of possession which is Jan'2013 earlier was Dec'2010. In the recent communication with them we have requested to send us the hard copy of Penal Interest detailed calculation sheet on their letter head with company's authorized signatory's signature with stamp. However, they are not revert so far.

We are seeking your help on this.

Legally you cannot be saddled with penal interest if there is no fault on your part in paying the price as per agreement. If you sign the supplimentary agreement then it shall be binding upon you. You can file a complaint in the consumer forum for delayed possession and seek compensation for the same
