Payment of full & final dues

My friend had working with a cooperative society, due some reasons/dispute with employer he resigned from the job without serving notice period which is 3 month notice. Now after expiring one month of resignation from the date of resignation, the employer has not intimate about his resignation is accepted or not. secondlly what is the maximum limit prescribed in law to settel the full and final dues of a employee after resignation.

kindly answer the above query with proper section of the Act, Thanks in advance.

FNF dues should be paid by usual pay day.

 

If employee has submitted resignation under proper acknowledgment it is good.

The employee may first submit a gentle representation preferably by redg. post, addressed to the appointing authority and demand acknowledgment/acceptance of resignation, correct FNF statement, payment of FNF dues by bank DD, Form 16 as per correct FNF statement, PF number/account slips/ESIC card if applicable, work experience/service certificate, relieving letter etc……………

 

If the society has its service condition/rules, then matter may be perused as per the same.

 

If applicable process of Settlements of Disputes may be followed e.g:

 

THE KARNATAKA CO-OPERATIVE SOCIETIES ACT, 1959.

CHAPTER IX

SETTLEMENT OF DISPUTES

70. Disputes which may be referred to Registrar for decision.- (

[(d) any dispute between a co-operative society and its employees or past

employees or heirs or legal representatives of a deceased employee, including a

dispute regarding the terms of employment, working conditions and disciplinary

action taken by a co-operative society 2 [notwithstanding anything contrary contained

in the Industrial Disputes Act, 1947 (Central Act 14 of 1947)]

ID Act may be pursued if employee is covered.

If the society is covered by Shops and establishments Act of the state and employee is covered by def. of Employee as in the Act, employee may proceed under it.
