Partition suit

I and 11 others jointly purchased a freehold plot and we engaged a builder to make 12 flats.For this we indivually have agree ment with the builder. During the intervennig period some people sold their share. After construction flats were handed over the owners. We are paying the municipal taxes for individual units as 'person liable' . We need to partition for individual mutation. At this stage some flat owners are not cooperating. So nine of decide to go for partition suit. Now the question is:

1. Do we nine have to pay the duty for the whole building?

2.What are options for other nine parties?

You all need not pay the duty for filing suit.  You have to pay the court fee for this you refer your state court fee and suit valuation act.
