Owner charging 40000 for painting charges

 

Hello,

   I was staying in a rented house for 3 years. then owner has asked to vacate the house.

In the agreement it was mentioned, that it was our responsibility to paint the house. but now he is charging 40000 for painting. and he is charging 11000 for breakage charge.

he didnt discuss about the cost before repairing and painting and now deducting the amount from security deposit.

40000 is a huge amount for painting charge. But in reality the painting charge would be 15000.

If there is anyway to get back the money ? if there is any law to support us ?

 

We have the rental agreement (expired) and his mail communication to support.

You can obtain the quotation from differrent firms for painting the house.

You shall find the estimate making tools at the website of good companies also e.g. Asian Paints, Kamdhenu paints, Nerolac, Beger, ICI, etc. The authorized stockiest of these companies shall give you estimate/quotation on their letterhead for 5 coat/7coat paint. Each  paint has 4 qualities from lowest to top brand.

For repairing also you can obtain the quotation from registered contractor.

If there is a huge difference you can contest.

Mr. Sakthi,

1) Do not vacate the place if u feel u have been cheating by the Lessor.

2) Since u had agreed in the rent agreement that , u have to paint the premises while vacating, u should abide with it.

3) if u feel he is deducting more, u get it done yourself.

4) Though your agreement is expired ( not renewed), since u are in the possesion of the premises, nothing to worry. Only thing is, u have to prove that u are paying the rental amount regularly without fail.

5) Amicable settlement is always better.

In your agreement it is mentioned that it is your responsibility to paint the house,not that the owner will get painted and you reimburse it,just say whatever work done is done by you. And you have already paid to painter.and don't vacate the premises.
