Sending a legal notice via WhatsApp can be tricky.

 Since you don't have the defendant's address, WhatsApp might be an option, but ensure you're following the proper procedure.

 Generally, notices are sent via registered post or email, but courts have allowed WhatsApp notices in some cases.

To send a notice via WhatsApp, you'll need the defendant's explicit consent to receive communications on that number. Try these steps: -

Confirm the mobile number belongs to the defendant - Send a message stating you're sending a legal notice -

Attach the notice in PDF or image format - Ensure delivery and read receipts are enabled - Keep a record of the conversation and delivery proof .

While the CPC mandates traditional service (Order V) and requires due diligence to ascertain the address, recent judicial precedents (e.g., Supreme Court, Bombay, and Delhi High Courts) accept electronic service as valid, particularly when traditional means fail. This is based on the test of effective service and often relies on the WhatsApp blue double-tick as prima facie proof of receipt.
 
Procedure Required:
 
1. Exhaust Traditional Methods: Send the notice via Registered Post to the last known address (if any) to document failure.
2. Send via WhatsApp: Send the formal signed PDF notice to the Defendant's confirmed mobile number.
3. Document Proof: Immediately take dated screenshots showing the delivery/read status (double-tick/blue-tick).
4. Affidavit of Service: Prepare an Affidavit detailing why traditional service failed, the time/date of the WhatsApp service, and annexing the screenshots as evidence.
5. Court Ratification: File the suit, submitting the returned postal article (if applicable) and the Affidavit, and seek the Court's formal acceptance of this method.
 
If the Defendant does not respond, you must then apply for Substituted Service (Order V Rule 20), presenting the WhatsApp evidence to support publication or other court-ordered means. WhatsApp service is best used as a supplementary tool to strengthen evidence, not as the sole method without the Court's explicit direction.
