Non payment of maintenance of apartment

I am the secretary of an apartment (not co-op housing society) located in Pune, Maharashtra. There is a member in our apartment who has made partial payment of maintenace of first six months of this year (April 2016 - September 2016). We had sent a bill of dues for second six months of this year (October 2016 - March 2017) including penalty of 12% on unpaid amount of first six months. This member was also on committee holding position of Treasurer but resigned midway. In his resignation he stated he is capable of protecting his house and does not need secuirty guards service we have at our apartment. He will not pay the maintenance for that.

The said member had time till 15th October, 2016 to pay the maintenace dues. The member didn't pay his dues in that period. On 10th November, 2016 we sent out a notice stating the remaining dues should be paid in next 10 days or we will have no choice to take action against him and all the expenses will be collected from him.

Questions: 

  1. What further action can be taken against this member?
  2. If a complaint needs to be launched, which office do we need to contact?
