Nil occupant in certified list of mbrrb

Hello - Our premises in a co-operative housing society is undergoing the redevelopment process. The flat is in the name of my deceased father who has died intestate. The secretary is denying transmission of our names as legal heirs in the share certificate under some flimsy reasons. A application regarding the same is in progress at the Joint Registrar Co-op Societies. The certified list of tenants in MBRRB records states 'owner' as my deceased father. But the 'occupant' is stated as Nil. The developer has obtained the NOC from MBRRB office and is awaiting the IOD. A legal notice intimating my claim on the premises is already sent to the Developer and the Society.

In such a scenario, how and with whom shall the Developer sign the Permenant Alternate Agreement? What are the actions or the re-course that I should take?

Generally, if the head or a member of a family expires, the next legal heir of the deceased, like wife or husband, son, daughter, father/mother may apply for legal heir certificate to get shares in any properties.
