NI Act - Issuance of witness summons to complainant

Please find attached a Judgment of Bombay High Court in the case filed u/s 138 of N.I. Act regarding issuance of witness summons to complainant. It is held that :

"On plain reading of section 254 of Cr.P.C. it cannot be said that the word "any witness" used in Sub-Section (2) of Section 254 does not include complainant. Even adversary including the complainant can be examined as witness."
