Dear sir,

You can appeal to higher court if suit disposed off in your absent. You are bound by judgment if it is in respect of property.

Are you the petitioner or respondent?  Any person having a valid legal title deed can dispose of the property and during that time if any suit is pending, the law is that transfer is subject to the outcome of that proceeding pending on that date.

You have not posted the material facts, highlighting the issue, if any.

I am petitioner and the suite is disposed. And the delay petition rejected. can my wife appeal as new petitioner on that and what is the period.?

T. Kalaiselvan, Advocate (Advocate)     08 January 2020

If the suit was dismissed for default and the condone delay petition filed to file the restoration petition was also dismissed then you may prefer a revision before the high court.

Your wife is not eligible to file a fresh petition or any other petition in this connection.
