Needs help from learned lawyers regarding family matter

Pl. go through the case history and suggest --- Case 1 - U/sec - 13(1)(a) of Hindu Marriage Act 1955 The husband filled an application against her wife. The judgement was exparte in favour of husband and marriage dissolved by a decree of divorce. The wife never appeared in the court. Wife left the house of the husband and started living separately. Case 2 -- U/sec - 10 of Guardian and Wards Act 1890 Husband filled an application against her wife regarding the custody of their minor children. Mother gave NOC and the custody of the children was given to the father with visiting rights to mother twice a month. Mother visits the children and father has no objection. Now the husband and wife wants reunion. They wants to live together for the rest part of their life. They both mutually agreed to live together without any issues. As they have been divorced by the court of law, how is the reunioun possible. They want the divorce decree and guardianship judgement cancelled. Under which section of which Act can the application be filled and in which court. Are there any judgements in such kind of matter. Pl. mention.

It is my opinion that one step forward and two steps backward is equals to doomsday.

Anyhow it defeats the purpose of getting divorce and also getting custody of children.

 

If you may so wish to rejoin, you have to get married again as divorcee and divorcee.  Best place to be done is via application to Sub-registrar who will get you married.

 

Regarding the custody of children, once you get married again, children and their ownership goes back to prevoius state.  Miya bibi razi to kya karega cozy.
