Candidates (or their agents) cannot enter gated community flats for canvassing as a matter of right without permission.Gated communities / apartment complexes are private property managed by an RWA/association. Entry is governed by the association’s rules, security protocols, and residents’ consent. There is no automatic legal right for a candidate to force entry into a gated complex for canvassing. Election authorities consistently clarify that:
Door-to-door canvassing is allowed only where lawful access exists
It does not override trespass laws.
Candidates may:
Seek RWA permission, Campaign outside the gate, visit individual flats only if invited by residents. Distribute pamphlets through security (if permitted)
They cannot:
Force entry, argue “election right” to bypass security, use police to compel access (unless there’s a specific local order).
Police generally support RWAs in preventing unauthorized entry
Election officers intervene only if there is discrimination between candidates, not to force access
Any breach may amount to criminal trespass under IPC/BNS.
