Medical negligence

Dear Sir,

  My 34 year old son died in a hospital due to HOSPITAL AQUIRED INFECTION (PNEUMONIA).

PLEASE HELP METO FIND OUT THE FOLLOWING.

(1) ARE THERE ANY GUIDELINES/NORMS/ PROTOCOL PRESCRIBED BY THE CENTRAL/STATE  GOVERNMENT / IMC ,FOR STERLIZATION / DISINFECTON ETC TO PREVENT HOSPITAL AQUIRED INFECTION.

(2) IF YES, WHAT ARE THE GUIDELINES/NORMS/ PROTOCOL PRESCRIBED

(3)WHICH AUTHORITY IS THE WATCHDOG TO SEE THAT THE NORMS AS PRESCRIBED ARE BEING FOLLOWED BY HOSPITALS/ NURSING HOMES.

(4) WHAT IS THE ACTION  PRESCRIBED TO BE TAKEN BY THE AUTHORITIES WHEN THE NORMS ARE VIOLATED..

The prospect watchdog would be the MCI whose intervention is a must whilst deciding the said standards of the hospitals and the doctors . The doctors are subject to the MCI in discharge of their profession. For effective guidelines wrt how the degree of negligence is determined in cases of medical negligence go through the land mark judgement of Jacob Mathew vs state . The nature of the action to be taken shall determine the authority to be approached . If a damages suit is required then a civil court is the best option to pursue effective remedy . Also you may alternatively / additionally register a case u/s 304-a/304 IPC against the hospital authorities or the doctor for the said unfortunate event . But then it's best to have a paralell and neutral medical expert determine whether or not the cause of death was actually what you are Considering it to be . That will substantiate your chances of success in court . Sorry for your loss . GOD bless u

Supreme Court of India is emerging as the harbinger of last hope for victims of medical negligence. MCI has never declared the medical hygiene standards to be maintained in both government and private hospitals. MCI or no other authority ever did surprise inspections of any hospitals to inspect the existing standards of compulsory hygiene systems to prevent spresd of infections in hospitals. MCI yet to organise any awareness programs on this subject for making patients and their family members aware of their right to systems in place to prevent spread of infections in hospitals. You have every right to seek justice from the SC of India by writing a post card. May justice be delivered to you.
