Maltreatment by father-in-law

A lady remarried at the age of 24 years, with a son from the previous husband. The present husband had been purportedly torturing the boy since he was 6 years old and that traumna has surfaced now. The boy is a brilliant student who has recently passed his MBA from a prestigious institution and has landed a job through campus interview and presently awaiting to receive his appointment letter. His childhood trauma has surfaced now and he has becomed a pysochological wreck and blames his mother for not protecting him. He is presently under pyshological treatment. The lady has another child from her present husband and tthe elder son from the present husband had been given the name of the present father. As such, the lady wants her son to be given her maiden title. Is that legally possible? And what is the recourse she has to take to attain a positive result. Kindly advise as the situation is very senitive and volatile at present.

The facts posted are less than convincing. Even if true, the issues too personal for a third person to intervene.

it is absolute;y true..  it is just to know if law can intervene to give the boy the mother's maiden title

Since the boy remained unadopted by present husband of his mother, he (boy) can be given his mother's maiden name.

Relation of the boy in question with present husband of his mother shall be step-father but in no case he (step-father) can be father-in-law as mentioned therein the subject of present query.

However, what is your locus standi and concern/problem  with the  boy in question ?

Consult a local prudent lawyer for proper analyses of facts and circumstances of the case, professional advise and necessary proceeding/action, if the query is not a hypothetical and academic for debate / time pass.

The boy would have mentioned his father's name in the birth certificate and all other documents including school and college certificates, if so, what was the name of father he had given in all those certificates?

Whatever the reason for change of his father's name any suggestion given without knowing the background reasons  specially at this adulthood stage would be a misguidance.

Hence as suggested by experts you may approach a local experienced lawyer and obtain opinion cum suggestions to move on in this regard on  all such future issues.
