Limitation

that i had given friendly loan for Rs 3 lakh in the year 2011 and the party had given post dated cheque of dated 2015 and i had filed civil suit in the year 2016 kindly let me know the limitation wiill run from the date of loan or from the date of cheque date give me any judgment which show the period been renew after the cheque dishonoured.

Your suit is time barred, limitation starts for initiating legal action is there years from the date of disbursement of loan and if part payment/interest or acknowledgement in writing is made within three years from the date of disbursement of loan then limitation period extends from date of such part payment/interest or acknowledgement.After leps of limitation period if any cheque has been given that does not extend limitation and not acknowledgement.

the cheque been given / issued before the limitation perod expired and the legal notice been given before the expire of three year of payment.

Loan given in the year 2011 ,cheque dated 2015 , obviously there years later,case is time barred.

The defended issue the cheque in the year 2013 and the civil case was instituted in the year 2016 wheather the period been revalidate or not
