Legal status

Civil court gave a divorce decree which I have appealed in the High Court. In my passport application form what will be my marriage status, divorced or seperated as I have appealed in High court. I mean legally, am I divorced till the high court decides or I can say the status as seperated. Please help.

well kindly provide reason for appeal, 

as you desired not to divorce or what.

if you have accepted divorce but appealing for claim or compensation to wife. then divroced

I am contesting as the divroce as is given on the grounds on the grouds of cruelty ( tubercolosis that I accepted after 20 days of marriage. Judgement says 'because you accepted tubercolisis you might be drinking and cruel') there is no compensation/ maintenance awarded.

well that means you desired divorce and you got correct me if wrong,

now you are contesting part of grounds of divorce only. then you can declare as divorced.

Mr. Sanjay,

You challenged the divorce decree passed by the lower court in High Court and the High Court heard you at the first instance and issued notice to the other party.  Hence, you are not divorced and your status is married till the disposal of case before High Court. (This inference also can be drawn on the ground that during the pendency of the appeal you are not allowed to marry).
