What is the complete process for filling a Pairvi application in the court and how the notices be sent to the parties.Is any court stamp reuired on the Pairvi application?

PAIRVI PROCESS

1. Visit the Court

Go to the court for filing the application to Perokar (filling officer).

2. Meet the court Perokar (Process Clerk).

Submit application to the Perokar (filling officer) with a ₹10 stamp. The

application must clearly mention that the matter is listed for Pairvi and briefly

state the matter for which the Pairvi is being conducted.

3. Provide envelopes containing application douments.

Provide separate envelopes (case details) for each party with complete party

address. Submit properly addressed envelopes for each party.

4. Sign and Seal of Perokar.

The Perokar will verify the documents and will sign and seal the envelopes and

accept the application.

5. Issues the Talwana.

The Perokar issues an approval notice (Talwana) for sending notices and then

collect the Talwana/approval document from the Perokar.

6. Visit the India Post GPO (General Post Office)

Place the Talwana inside each envelope along with the appeal documents and

send the sealed envelopes to the parties via Speed Post. Keep the Speed Post

receipt as proof of dispatch.

7. Application to the Hon’ble Court

Now we have to submit the GPO Post Receipt to the Hon’ble Court by annex in the

A Pairvi Application (Petition for conducting/assisting in prosecution) is usually filed by a complainant, victim, or interested party seeking permission of the court to assist the prosecution or personally pursue the case when the Public Prosecutor is conducting the case. This is common in criminal cases when the complainant wants to monitor or assist the prosecution.

The legal basis generally comes from Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) — particularly Section 301(2) and Section 302 (earlier Sections 301 and 302 of Code of Criminal Procedure, 1973).

You may file an application before the concerned court by complying with the procedures as advised by the above expert advocate.

If the application is allowed then the advocate can assist the prosecutor, cross-examine witnesses (sometimes with permission), and file written submissions.

Move an application before Trial Court to proceed on his/her behalf with an authority letter of concerned accused / respondent / defendant (as the case may be).
