in theyear 1972 my father purchased a 5 pieces of land for which he has a registerred agreement. he sold 3 parts of the land in 1995 for rs 7 lakh. the builder pd was suppose to make complete payment by dec 1997. but dad expired in june 1997. afterr which the buildeerr took us i.e. my mother, myself and my younger sister to his office and asked us to sign another agreement telling us that thru this agreement he would transferr the property in our name and the proceeds can now be given to us. my mother is not highly educated and is not able to comprehend much of english from the document, and also she was frightened for us aswell as we were surrounded by the builderrs men and we had no support of any other male member in our lives. she signed the document and i too who was only 17yrs of age signed and accepted it. the builder neverr gave us the document copy.he paid us rs 20000 and after that even after repeated personal visists and phone call no money was paid. so till date he paid us rs. 5lakh( including amnt pd to my father)
in the year 2000 we sent him a cancellation notice. within 2 days he sent his men to our house and took us to a lawyer and asked us to sign another peice of paper which said that we are cancelling the notice and we will not sell the land to anyone else. here i signed as a witness. he paid us rs 5000. we in good faith thinking that we will be paid the balance amnt and the deal will go trhough we signed the document.
but yet again he defaulted. so in the year 2008 my maternal uncle who was given a poa by us brought us a new builder and we sold the property to him. paper notices were published and on seeing that the earlier builder sent a notice that the land has already been sold,, but when papers were asked to be shown he didi= not trun up. but after t he new agremeent of sale was made the old builder files a case against us claiming fraud and also rs 5 crore for specific performance. also the new party has been made respondents.
we don't have a proper lawyer nor do understand much into this..hence kindly help us to know where do we stand in this case and how can we settle or win this matterr. i also know that there exists a timelimit for payments in any agreement made.
