an employee worked in an organisation for 5 years and resigned and the resignation was aceptted as there were no remarks on him .after resignation  he claimed gratuity but the company rejected citing some reasons.
simultaneuosly the employee joined in another new  co., which is 300 kms far from the old co., thereby shifting his residence near to the newly appointed co
it is difficult for him to travel and file a case in the old co.,
Now can he file a gratuity case from the place of the new co where he resides now.  
both places are in tamilnadu.

The employee cannot file the gratuity case at the place of new employment merly because he has shifted. The gratuity claim must be filled where the old employer establishment is situated. A gratuity claim has to be filled before the controlling authority having jurisidiction over the establishment where he last worked. Place of new residence is irrelevant. Gratuity cannot be denied except in very limited circumstances (like termination for moral turpitude, riotous conduct, etc., after due inquiry).

The employee shall file the case where the action arose, i.e. at the place where he worked previously but not where he resides.

Yes, the case needs to be filed within the jurisdiction where the cause of action had arisen.

The law will not bend to the convenience of an individual.

You may have to approach the legal forum situated within the jurisdiction where the original cause of action arose.
