Kalamazoo jury awards $1.23 million

According to a report, a jury in Kalamazoo has granted a settlement of $1.23 million to a woman’s family after she passed away from a brain injury she sustained from a shortage of oxygen during a surgical procedure in 2008. According to court records, Maria Garcia entered the hospital for surgery on her neck to remove her thyroid and parathyroid glands. Allegedly, during Garcia’s stay in the recovery room, the staff tried unsuccessfully to wake her up.

 

The lawsuit faulted Dr. Elmon Oliver Jr., the anesthesiologist, for failing to notice that the tube used to supply oxygen to Garcia, had shifted following the administration of the general anesthesia and was prohibiting her from breathing independently. Additionally, the lawsuit states that during the surgery, Oliver did not address Garcia’s low blood pressure, which could also lead to brain injury. Reportedly, hospital tests following the operation, concluded that due to the lack of oxygen, Garcia had suffered a brain injury. It was reported, that 11 days after surgery, Garcia died after being removed from life support and the autopsy report concluded that there was no explanation for her death aside from not receiving sufficient oxygen.
