Joint ownership of property

Hello Sir,

Myself, my younger brother and mother inherited my fathers property after his death. We sold the property and got 1C jointly between 3 of us. My younger brother is married and settled in US, and myself (unmarried) and mother are here in chennai. Now we decided to purchase a plot and register between all three of us. total cost of plot is around 1.3 C. so we will go for loan of about 30L split between 3 of us.

Is it possible to buy plots this way by having multiple ownership? How should we approach this for registration? What are the other implications we need to take care of?

Joint ownership is possible.A co-owner/joint ownership is entitled to three essentials of ownership:

  • Right to possession
  • Right to use
  • Right to dispose off his share of the property if it is clearly stated, in the deed.

Therefore, if a co-owner is deprived of his property, he has a right to be put back in possession.

Sorry , bit diverting attention , in long run many properties are cause of family conflict. So if you are taking new property take separate. May be one survey no. for you, neighbouring for your brother and third one for third and be financial independent but close. 

You can have good neighbours if your borders are defined . After 2 generation there are always 5-6 people including legal heirs of girl child and they eventually fight with each other this is general experience in society
