If the Advocate's clients do not wish to continue with the civil suit, should the Advocte continue to fight the case against the wishes of his clients?

If the case really involves question of law which has made grave injustice to the clients then he can move further in the case. I think we are all assisting to administer justice to general public . so we being a amicus curie in real sense should help people to get out of such unsatisfied conditions where they have a mind set that they wont get justice..

I do agree with Mr. Doveson, if the client is not ready to continue to get your services how u will continue, u should withdraw your Vakalatnama from the suit immediately.

@ N.K Assumi What is the need to fight the case against client's wishes. At the end, your client will say some piching words to you.They will not give u even a single penny for your hard work.

Since the Counsel fights the case on behalf of his Client and on his instructions only and when the Client do not want to proceed the case, the Counsel cannot fight the case further any more.

we act on instructions and on behalf of our clients if the Client do not want to pursue the casewe will have to act as per his wish,

No it is not proper, but let the client declare beforre the court and do not declare it unless and until the client gives in writing and files papers before court. What is imoportant it is for the client to declare before the court. Now a days clients are very wise or say over wise and some time they involve for mis conduct. Better declare no instructions.

without the clients approval no advocate SHOULD go for this case. Read Vakalatnama's contents and no advocate is so sympathetic that client is forcing him to go away and he is forcibly coming to attend the case. There must be some ... FISHY..........
