Ipc 406

HI,

One of my friend was on an official visit out of town, when he came back he found that the Locks of the House were changed by his wife, with no communication (Phone, Email, Whatsapp etc) from the wife on the reason for the changed locks. He then went to reside with his parents.

The house if owned by my friend's father where my friend & his wife were residing from past 1.5yrs.

Aabout 15 days after this incident there was a fake DV case filed by the wife against my friend which he is fighting. Considering the above can he file a 406 against his wife ?

Please advise.

Husband has to reply to her DV Case. No 406 section in this regard.

Husband has already replied to the DV case. The question is that can he file 406 against his wife.

On given facts no case u/s 406 of PIC is made out.
