hi..... An RFA came to be dismissed for default. Filed a mis. Petition under o.41 r.19 and it was also dismissed for default. Note, filed a MA under o.43 r.1(t) before district court. Whether non speaking order comes within the ambit of above said provision and could we say that such an appeal is maintainable before the district court. Found one precedent but it's real old. Could anyone help me new precedents.
