I am new lawyer from maharashtra and its my first case, so please help me to know that-
Husband is Labour, no proof of income, he is HIV positive. first wife have 2 childrens. It came to notice that he have IInd wife with 4 childrens. 498(a) along with 494 is filed . crpc 125 and DV cases are filed. In DV case Protection officers report proof of second marriage and berth certificates of 4 childrens are produced before the court. In DV case for interim maintenance the matter is for arguments on 09 Jan 2012.
1) in argrments what amount should be asked, based on what provision?
2) Will he be convicted for 494 ?
