information regarding 25h of id act

sir my wife is a retrenched employee of BBMB. the case is pending before the centrel labour court/tribunal at chandigarh. but the department now notifed in news papaer some fresh jobs and my wife applied for the same and by giving request letter claim reemloyment U/s 25-H Of ID ACT against these jobs . but now the selection procedure is over and department refuse her claim. we also gave an application to the labour court witch is still pending.

now please sugest us what we do?   is the application u/s 25 h of  id act which is pending before the court is sufficent or we approch the labour commisionar for concilation proceeding.

You insist the labour court to dispose your application on merits instead of keeping it pending.  If the order goes aganst you, you can take up the matter with the High Court under writ jurisdiction.  Otherwise your application in labour court be kept pending and all the vacancies would be filled up.
