Illegal Registration

D. Satti Reddy (land lord) has sold a land which has (2) roads (first facing east & second facing north which is main) to my father in the year 1995 and in the sale deed the survey no.44, plot no.1 (correct are Survey No.43, Plot No.18) were mentioned wrong. In the year 2002 while my father was applying for home loan those mistakes came into light and my father could only rectify the survey no.43 from 44. But the plot no. was not rectified by the vendor (D. Satti Reddy) with wrong intentions as since we are objecting him to sell the road facing towards east of our plot (mentioned road in our sale deed). And now the same D. Satti Reddy has come up with registration documents of that road mentioning it as a plot, which he gifted to his son as a gift settlement deed of family in the year 2013 and trying for construction. He also got injunction order from court that we should not object him from construction. and he also got a layout in which it is mentioned our plot as no.18 and the road he registered on his son name is plot no.18a. what we need to do? As since he (D. Satti Reddy) is a land lord no one is supporting us in this matter. The local police are also not intervening into the matter as it is a land problem. 1. Rectify out plot no. and keep calm regarding the illegal registration of road? 2. Where do we need to fight for the public property i.e., road? 3. Do we face any problem in future, regarding wrong plot no. in our sale deed????

can the same person who sold the plot to us showing 2 roads and register the other road on the name of his son asking us to use the common road.

If you are serious about the matter, don't you think that you should consult a local lawyer, who is well versed in property law and discuss the matter by showing the documents in your hand and then take steps as may be advised by the lawyer?

Sir, The local lawyer is asking us to pay Rs.20,000/- and he will arrange another lawyer to file a case in court against him for producing fake registration documents.

If you feel that the charges are more, why don't you approach another lawyer, who suits your pocket?

Mr.Chandrasekhar,

Seeking guidance from open forum without studying the documents may create confusion.

No doubt, you have been cheated, and there are legal remedies both under Civil and criminal grounds.

Either contact some other advocate or approach legal services authority if you are eligible to get such free services.

Understand the complications involved.  This may be first time for you to face such problem.  There are hundreds and thousands of such cases  daily and you may be one among lakhs of such consumers.   You can also file a case under consumer court also and if you appear in person the total costs may not exceed maximum Rs.500/-.  Remember there is limitation period every thing.  Because the seller has obtained injunction, do not think that is permanent.  Cheating is always cheating.  Find a competent advocate that can understand your issue and suits your budget.
