I won an arbitration award against my stock broker. he filed a s. 34 application in the district co

I won an arbitration award against my stock broker. He filed a S. 34 application in the district court which was dismissed.  Then he filed an appeal u/s 37 in the High Court.   The High Court has sent me a notice asking me to appear before it within 30 days.  The appeal has not yet been admitted.  Hearing date has not been fixed.  So, where should I appear?

What is the opinion of your lawyer? Before admission of the appeal, the court may ask why action should not be taken on the appeal filed against you.  So, you shall appear before the HC within the time.

You can engage an advocate practicing in high court, file vakalatnama and counter affidavit anytime before 30 days in the High court registry, once the matter is taken up for listing, your advocate will record your objections against the appeal before it is taken up.

If you have received notice from High Court, you should (must) appear through your lawyer,

Show relevant records to your lawyer for proper appreciation of facts, professional advise and necessary proceeding to protect your interest.

Appear before High Court through lawyer and raise objections regarding admission of appeal and on stay application.

The point is, hearing date is not fixed.  If I go on any day, the file will not be before the judge.

You can file vakalatnama as well as your counter objections with the high court registry and appear before high court when it is listed for hearing.

You can consult an advocate practicing in high court on all such further issues.
