Passport and fir

Will I get passport if there is FIR filed on me under 35(i) bnss and the Status was referred further action dropped.

1. Is it necessary to mention this FIR in passport application 

2. During verification if I not present in home. Will the police tell the FIR to my family.

If action is dropped in a criminal case at the FIR stage, it generally should not impact the issuance of a passport. Courts have consistently ruled that a pending FIR, without a chargesheet being filed or the court taking cognizance, is not a sufficient reason to deny a passport. 

Filing an FIR (First Information Report) is a preliminary step in a criminal investigation. It doesn't automatically mean someone is guilty or has committed a crime. 

Mere pendency of an FIR does not disqualify an individual from obtaining or renewing a passport. 

While police verification is part of the passport application process, it's primarily to ensure the accuracy of the applicant's details and check for any criminal history. An FIR that has been dropped should not negatively impact the police verification process.

However you may have to disclose the details of FIR  and the action dropped report also in your application for passport.

But sir the police Didn't told me about FIR. I. KNOW it once after I check on online only

Do you admit that you were implicated in the offence?

If yes, then it becomes your duty to follow it up and get it disposed, you cannot blame anyone for your own mistake

It cannot be said that a criminal action is pending only when the summons is served upon the accused to stand trail.

If you were knowing that the police had taken action drop report action in your case, then it is very clear that you are aware of being implicated in a criminal complaint, hence an adverse inference can be drawn on you for not disclosing the details of a FIR registered against you and the details of its disposal in your application for passport.

The issuance of passport is subject to police verification report, hence very sensitive, therefore you should have exercised more caution instead of remaining so casual about it.

My earlier reply "It cannot be said that a criminal action is pending only when the summons is served upon the accused to stand trail." may kindly be read as "It can be said that a criminal action is pending only when the summons is served upon the accused to stand trial"
