HR forcing to stay in company for more then Notice Period

 

Overview

 

I have been in corporate IT companies since 5 yrs and seen all in and outs of their process

At one hand there are companies who even dont keep resources on their payroll

So they can hire and fire in nights

On other hand there are companies, who are buying peoples on payroll.

But once you join the company. If becames very hard to comeout.

In today's life its more profitable to work on contractual project then on payroll one

As you can put paper in 15day and get lost from the office.

But if you are permenent employees..

You are gone.

Lets find Why a person will change his/her job?

   1) Location:-   

In today's era location is biggest key driver for the job change as when resource finds life is settling down.

He/she will prefer to be in home town, rather then in some alien city

Unfortunately but true that still IT companies are bullying for the location, they are very rigid for location.

And 90% IT companies are setlled in one part of India [ No need to mention ]

So if you are IT engneer and fresher, you have to travell down wherever they want.

At that time location is not choice its the only option to you.

And when you gain some experience and now want to go back to your home town, your company does not have any project or proper opportunity suites you.

The only wayout is the Resignation and find a new job.

Money:

This is key driver and happening thing of the world

If you beg for promotion, increament, nothing will happen.

Find a new job, bargain whatever package you want is today's funda.

Inproper work Environment

This is new but now a days common in IT. the work culture in some companies have rotten to such extent that one may prefer to put paper and run away from company.

So what is problem?

 

The new thing started in IT is, notice period.

Most of companies have some notice Period ranging from 60 day to 120 days max.

But dfgdf, even companies are not bothered of it.

They are asking rather forcing resources to stay more then the notice period.

If that is not done they are bullying to take legal action

As per their information, companies may extend one's release from organization if they want to based on businessneeds.

As all the big companies are mentioning in very small font some where in offfer letter that the terms and condition may change at any time without notice.

And becuase of this the person is loosing job offer and reputation in current orgnization.

Without your willingness you need to work for half year and face the anger and discomfort from family.

This HR and top management bullying has crossed the levels and there is not any legal body in India who can control in such situation.

It is biggest challane in Today;s worklife for any one.

today it is happening in IT, tommorrow it will happen everywhere.

And in same company on same role, if you work in USA and with H1 visa.

you can put paper in 15day notice and vanish out of company.

coz the law in USA are very strict and supportive to some extent to employees too.

Lastly the dialogue from "D Company" -- This is dedicated to who they have put paper and still not able to go out of orgnization.

"Idhar ata apni marzi se, par jane ka koi rasta nahi."

 

And very often called in Bollywood. -- this is dedicated to fresher who are forced to depute in mentioned location [ that is only one state ]

Babu ek vesya kothe par apni marzi se nahi ati......

Conclusion

The IT business have became the blood business. to retain the resources and get the good image in clients, IT companies are ready to do anything

What supports them

1. They are in India -- So they know nobody can do anything to them

2. They have setup their business in majorly in only particular state , So they are fully backed from state Govt.

3. Anyways no one can spoil his/her life and get bad remark in release latter

Hi,

Whatever said is 101% right there should be some rules and regulation on notice period and job location and more is the work pressure we get in IT companies, the work pressure in these companies is very high and it also cant be seen as its not physical work.

there should be only 1 month notice period.the employee should get his preffered job location withought any constraintsof employer, and he should not wait for that.

Guys this situation is not only in IT industry. Same exists in all forms of Firms and Industry in India. I am an officer HR in a Metal gaint. Can we workout under aiegis of some legal patrons to form a cross industrial  legal association to help out such issues. The revenue generated through the nominal fees may be used for running the association.

Any patron can help with the plan????

Dear All,

what ever stated is correct but only remedy is to take legal recourse in time. if the employer finds that the concerned person is backed by a person who knows the law will change the situation. Automaticaly the issue will be resolved in time or he should be ready to face the legal implication. When ever such situation arise, dont hesitate to approach a lawyer who knows labour laws very well.

Hi,

 Thanks "Sanjeev" and "Ilyas" for the sharing your thoughts.

But everyone knows that court and law works in years not in days.

And still today average civilian tries to not to get involved in court matters.

No one knows how huge syndicate this is?

Look at end all this IT companies are inter-connected.

Whichever you choose, the curse will chase you.

None of company prefers a employees who is known for talking the language of "Law".
