How long it is going to take?

Dear friends,

Please excuse me for not sharing real names. I am in great distress and really think, I might get a clear picture of what I want with your help.

We were married 3.5 years ago. We had registered our marriage the next day as well. Within 4 months a rift between us had made my wife to leave to her parents house. Three months passes as we attempted to invite her back. During these three months of attempt, we were given certain excuses on why she cannot return back to my house. All of sudden we came to know she had applied for annulement of marriage through a HMOP (after 8 months from wedding). All our efforts to request her to withdraw the petition went in vain. In that petition the petitoner (my wife) had asked to court to annule the marriage citing various reasons.

Court rejected her petition as one year was not completed.  She filled again another petition after completion of one year. When the case was transferred to lok adalat, they demanded financial compensation which I was not agreeing to pay, as I said i am ready to live if she comes and if she doesnt want I can come to mutual consent.

Since she was adamanet in getting money, she rejected and the case was transferred back to court. This happened 1 year ago and then after for every appearance the petitioner doesnt appear and request for adjournment. Evey adjournment takes away approx 3 months.

What can be course of the court, if such adjounments are continously sought by petitioner?

I am ready for the divorce and my lawyer says I can be come an ex parte to get a quick solution as the petitioner also claims to grant divorce and no other grant is asked for. Is there any possibility for me to request the court to limit the adjournments granted or speed up? At worst, how long will this process can take?

There is limt for the adjournments.  Normally some courts take much time in divorce cases, because some times there will be chance of reunion.  If your wife has prayed for the divorce, just you file a memo stating that petition may be allowed.
