Hindu marriage process

Hello I am Rohit, and my partner is Ritu. We are both Hindus from different families. I am 22 and Ritu is 19. Despite our families opposing our relationship, we married in a temple following Hindu rituals, with a few friends as witnesses, and started living together. Later, our parents claimed the marriage is invalid because it wasn’t registered. Can you explain the legal process for registering a marriage under the Hindu Marriage Act, and what documents are required to make it legally valid?

Hello Rohit. This is the process according to my knowledge on Hindu marriage

 

 It applies when both partners are: HINDU, SIKH, JAIN, BUDDHIST

· Where marriage ceremony is performed according to Hindu custom and rituals [SAPTAPADI (7 steps around the fire), KANYADAN (giving away the bride), AGNI PUJA (Sacred Fire) etc.]

· After these rituals the marriage is considered religiously valid and then Husband and Wife submit a joint application to the Marriage Registrar for marriage registration.

· Then see that you have the given documents in to prove your marriage before the resgistrar:

 

  • Proof of age (Aadhaar Card / Birth Certificate)
  •  Address Proof
  •  Marriage photos
  •  Wedding invitation card
  •  Identity Proof
  • Affidavit of Marital Status
  • 2 or 3 witnesses ID’s

. Now couple must appear in the registrar office with 2 or 3 witnesses. Witnesses confirm that the marriage actually took place .

· Now the registrar checks and verify the all documents of couple and witnesses and then witnesses confirm that marriage actually happened. If everything is correct the registrar approves the registration.

. The Registrar records the marriage in the official register. After registration, the marriage certificate is issued. This certificate is legal proof of marriage.

Marriage laws vary from State to State. The procedure given by Aditya Uniyal is valid everywhere. Some States have sinplified procedures to encourage inter-caste marriages. In Tamilnadu even Police Stations can perform such marriages.

You stated that both of your families opposed your relationship. Is it under Sapinda?  You both got married in the temple under Hindu rituals and the priest performed it, and now you can get your marriage registered.  The registration of marriage is not compulsory in some states.  You both shall submit the marriage application in the prescribed form with a declaration that this is your first marriage with three witnesses (all are signatories) and Aadhar cards of all.

Author is "Sweta Bharti", bride is named as "Ritu" whereas groom's name is stated to be "Rohit", implies that either it a fabricated or time pass question paper.
