I have taken a rent home at Ahmedabad. Now few days before HDFC bank officer came with police protection to take possession of home. Actual matter is that my owner bought home through cooperative bank in auction. And earlier owner take two loans from bank one personal loan from cooperative bank and one loan from HDFC bank against property. Before auction add given by cooperative bank in news paper.

 

My owner not had given possession of home to HDFC bank. Now HDFC bank file petition against all including me in police station. Now every day police call me to police station and tell me that you have to came court for bail.

 

Now suggest me what to do?

1) Under what Section has a case been filed against you  which requires you to get Bail ?

 

2) What is your Landlord telling you to do ? Do you have a clear and proper tenancy agreement ?

 

3) Prior to this action , what have been the proceedings against you and what have you done regarding the same ?

 

Once you provide these details, some advice may be given.

 

Generally, if your Landlord has a registered property deed in his name  he is the legal owner and only he can ask you to vacate the house. The case of HDFC, if any, lies against the Landlord not you.
