Grand fathers property

Hello,

I need the experts advice with the property issue We are having.

We are a Hindu family from Guntur, A.P.

My grand father has 3 sons and my dad being the eldest one.

Two years back my dad and grandfather passed away.

Before my grandpa passed away he wrote a will for 2 acers of land( his own land not ancestors) on to his 2nd son and we are still left over with 2 acers of land to be partioned among 2 sons and my Mom.

1) can we(Mom & son) claim share in the 2 acers which has been given to his 2nd son?

2) When we enquired about the partition about other 2 acers MRO office said we have to register it on my uncle (2nd son) name then only we can get it from him and we don't trust him.

Please guide me what is the right thing to do here.

2. no thats not needed.its considered as intestate property.you can file a partition suit straightaway to claim your share but your uncle will also get a share out of it as he is also a legal heir
