Gift Registration

Hi My name is Ravi Kishore requesting all your suggestions for the below issue. My Grandmother gifted her property to my dad in 2008 for converting her thatched house into modern building. My dad after gift registrations constructed the house by mid 2009 by taking some home loan. Later in sept 2009 my grandmother cancelled gift registration without his notice and we didnot know about this cancellation till now. My grandmother expired last year and my dad passed away recently and we are paying all the govt taxes and home loans regularly. Please advise how i need to challenge this case in court as my father was frauded by my grandmother.

Was the gift of immovable property registered by donor with O/o Registering Authority?

{Apparently yes since home loan was availed by done}

Asit seems from your post, the gift was accepted by donee and possession was also taken.

Was gift deed submitted to for updation in mutation records?

(Apparently yes since home loan was availed by donee)

Afrer your father’s death did you submit death certificate, legal heir certificate to authority under whose jurisdiction property falls to record inheritance, thus ownership by inheritance.

Apparently: the donor has merely registered a cancellation deed and gift is not revoked by court of law. After donee’s (your father) death his legal heir steps into his shoes. Cosnult local counsel of unshakable repute and integrity, specializing in revenue/property/civil matters, along with copies of all property related docs, for a considered opinion.
