MY FATHER AND HIS PARTNER BUY A LAND JOINTLY IN SINGLE SALE DEED IN 1998. WITHOUT KNOWLEDGE OF MY FATHER , HE SOLD THAT LAND TO XYZ IN JAN 2010. MY FATHER PUT UP A APPLICATION BEFORE THE COURT OF LAND REFORMS DEPUTY COLLECTOR AGAINST THAT LAND UNDER SECTION 16(3)(i) OF THE BIHAR LAND REFORMS(FIXATION OF CEILING AREA AND ACRUISITION OF SURPLUS LAND)ACT 1961 FOR PRE-EMTION.

AFTER GETTING NOTICE FROM COURT. XYZ REFUSED LETTER AND STARTED ILLEGAL CONSTRUCTION OF HOUSE.

FOR STOPPING CONSTRUCTION TILL FINAL DECISION OF COURT. 

 

MY FATHER VISITED POLICE STATION FOR REGISTERING FIR REGARDING ILLEGAL CONSTRUCTION OF HOME IN MY PARTNER LAND. 

POLICE REFUSED TO TAKE ANY ACTION AND FOR REGISTERING FIR.
 
I AM IN DEFENCE AND AWAY FROM HOME. SAME COMPLAINT SENT VIA FAX TO SUPDT OF POLICE BY ME BUT NO ACTION SEEMS TO BE TAKEN PLACE.
 
SUGEST ME WHAT I HAVE TO DO FOR REGISTERING FIR OR STOPPING CONSTRUCTION AS MY FATHER WANTS TO PURCHASE THAT ADJOINING LAND.

In your case police has nohing to do as this is purely a civil matter and being a partner, he has encroached uon there and why to say encroaching say has duly started construction thereon. In this matter, you go to civil court seeking partition and possession thereto.

i  agree with Mr.Raj kumar, you have to appraoch the civil court seeking  suitable relief

Aside from this case, I think now FIRs can be registered online at least in Metros.
