Hello Masarat
Legal ways to recover school fees from defaulting Parent :-
Issue a written demand notice to the parent specifying arrears and deadline.
File a civil suit for recovery of money (or summary suit under Order 37 CPC if there is a written undertaking).
If a fee cheque is dishonoured, initiate Section 138 NI Act proceedings.
No harassment or child punishment is allowed; recovery must be strictly through lawful civil/criminal process.

These rules vary from state to state and between central schools and private schools, and unaided schools. If any school obtain an undertaking from the parents, such schools only file recovery of school fees, but it is the right of the children to receive free education as per the Right to Education Act.

The recovery of school fees from a defaulting parent must be done strictly through lawful and non-coercive means. Schools cannot punish the child for the parent’s default.
You can issue a legal demand notice demanding the outstanding fees, if there is no response or not complying with the demands, you can file a recovery suit to recover the arrears of fees.
If the admission form includes an arbitration clause, recovery may be sought through: arbitration proceedings under the Arbitration & Conciliation Act, 1996.

Step 1: Send a formal communication mentioing the student name, due date, period of default and requesting to make payment.
Step 2: Issue a legal notice to parent/guardian through advocate seeking payment for school fees
Step 3: School can file a civil suit for recovery of fees, interest and legal costs. School can opt for summary suit or regular recovery suit

First, schools should ensure their admission form, fee circulars, and parent undertakings clearly mention the fee structure, due dates, and consequences of non-payment. These documents form the legal foundation for recovery.
If reminders don’t work, the most effective next step is sending a formal legal notice demanding payment within a fixed time. This often resolves the issue without escalation, as parents realise the school is serious and legally prepared. A well-drafted notice also creates a paper trail if the matter goes further.

If payment is still not made, schools may initiate civil recovery proceedings for unpaid dues, supported by admission records, invoices, and communication history. In many cases, courts favour institutions when documentation is clear and reasonable.
