Being falsely implicated in an NDPS (Narcotic Drugs and Psychotropic Substances) case can be a traumatic experience. Here are some steps you can take to defend yourself: 1. Seek legal counsel: Consult a lawyer who specializes in NDPS cases. They can guide you through the legal process and help you build a strong defense. 2. Gather evidence: Collect any evidence that can prove your innocence, such as witness statements, video footage, or documents that contradict the allegations. 3. File a counter-complaint: If you believe you've been falsely implicated, file a counter-complaint against the person(s) who made the false accusations. 4. Cooperate with investigations: Fully cooperate with the investigating authorities and provide them with any information or evidence that can help clear your name. 5. Seek bail: If you've been arrested, apply for bail and seek legal assistance to secure your release. 6. Build a strong defense: Work with your lawyer to build a strong defense strategy, highlighting any inconsistencies in the prosecution's case and emphasizing your innocence. Remember, being falsely implicated can be challenging, but with the right legal support and evidence, you can fight the allegations and clear your name. Please consult a lawyer or legal aid organization for specific guidance on your situation.

You may have to challenge the false case filed against you on the basis of documentary evidences in your possession and on merits.

The informer's evidence in your favor will be a vital one to come for your rescue

Thank you so much sir for reply

  1. till now not arrested so court issued notice section 82 that if not surrender within 30 days our property will be attached by police (now our advocate given application in the court against section 82 notice)
  2. Counter complain : we went to police station but they din't take complain they wanted to arrest him than he complained to SP which we have received from sp office but no action has been taken till now.                       is complain to sp receiving copy will be benifit to grant bail or case investigation?

If your counter complaint has not been entertained by police then you can file a petition before judicial magistrate court under section 156(3) cr.p.c. seeking direction to concerned police for taking proper legal aciton including registering FIR on the basis of complaint made by you.

The bail applicaiton has nothing to do with your counter complaint in this regard.
